1. Eligibility

OnlySniff is strictly intended for adults.

By using the Platform, you represent and warrant that:

• You are at least eighteen (18) years old or the age of legal majority in your jurisdiction, whichever is higher.
• You have the legal capacity to enter into a binding agreement.
• Your use of the Platform complies with all applicable laws and regulations.

Access by minors is strictly prohibited.

2. About OnlySniff

OnlySniff is an online marketplace and creator platform that enables verified creators ("Creators") to:

• Sell digital content.
• Offer private messaging and chat services.
• Sell physical products through creator-operated shops.
• Interact directly with customers and fans.

OnlySniff acts as a platform provider and does not create, own, produce, or endorse creator content, products, or communications unless expressly stated otherwise.

3. Account Registration

Users may be required to create an account to access certain features.

You agree to:

• Provide accurate and complete information.
• Maintain the security of your account credentials.
• Promptly update any inaccurate information.
• Accept responsibility for all activities occurring under your account.

We reserve the right to suspend or terminate accounts that contain false, misleading, or fraudulent information.

4. Creator Verification (KYC)

Creators must complete identity verification before selling content, products, or services through the Platform.

Verification may require:

• Government-issued identification.
• Age verification.
• Identity verification checks.
• Additional documentation as required by law or compliance partners.

OnlySniff reserves the right to reject, suspend, or revoke creator verification at any time.

5. Creator Responsibilities

Creators are solely responsible for:

• The content they upload.
• The products they sell.
• Communications with customers.
• Fulfillment of orders and services.
• Compliance with applicable laws and tax obligations.

Creators must accurately describe all products, content, and services offered for sale. Misleading listings, false advertising, fraud, or failure to deliver purchased items may result in account suspension, payout restrictions, or termination.

6. Content Ownership

Creators retain ownership of the content they upload. By uploading content to OnlySniff, creators grant OnlySniff a worldwide, non-exclusive, royalty-free license to host, store, display, distribute, and promote such content solely for operating and improving the Platform.

Creators represent and warrant that:

• They own all rights necessary to upload and sell the content.
• All persons appearing in content are verified adults who have provided consent.
• The content does not infringe third-party rights.

7. Prohibited Content and Activities

The following are strictly prohibited:

• Content involving minors.
• Non-consensual or exploitative content.
• Violence or threats of violence.
• Harassment, hate speech, or discrimination.
• Fraudulent or deceptive activity.
• Intellectual property infringement.
• Illegal goods or services.
• Impersonation of another person.
• Uploading stolen, leaked, or unauthorized content.
• Attempts to bypass platform security or verification systems.

OnlySniff reserves the right to remove content and terminate accounts without notice for serious violations.

8. Payments

OnlySniff supports various payment methods, including:

• Cryptocurrency payments.
• Credit and debit card payments.

Third-party payment providers including, but not limited to, NOWPayments, Revolut, Crypto.com, MoonPay, and other supported processors. Payment providers operate independently and may impose their own terms, fees, verification requirements, and restrictions.

OnlySniff is not responsible for payment provider outages, delays, compliance reviews, blockchain network congestion, or transaction failures beyond our reasonable control.

9. Creator Payouts

Creators may receive earnings directly through supported cryptocurrency wallets. OnlySniff currently operates a 0% platform commission model; however, we reserve the right to modify pricing, fees, commissions, or payment structures in the future upon notice. New creators may be subject to temporary payout holds, reviews, or verification periods designed to protect customers and reduce fraud.

10. Physical Product Sales

Creators offering physical products are solely responsible for:

• Product legality.
• Product descriptions.
• Packaging.
• Shipping.
• Customs compliance.
• Delivery obligations.

OnlySniff does not manufacture, inspect, store, or ship creator products.

11. Buyer Protection

OnlySniff may offer buyer protection programs, dispute review processes, or transaction investigations at its discretion. Buyer protection decisions are final unless otherwise required by applicable law. OnlySniff reserves the right to request evidence from buyers and creators when resolving disputes.

12. Intellectual Property

All Platform software, branding, trademarks, logos, designs, and materials owned by OnlySniff remain our exclusive property. Users may not copy, reproduce, distribute, reverse engineer, or exploit Platform materials without prior written permission.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy.

14. Account Suspension and Termination

We may suspend, restrict, or terminate accounts at any time if:

• These Terms are violated.
• Fraudulent activity is suspected.
• Legal compliance requires action.
• Platform security is threatened.

Termination may result in removal of content, suspension of payouts, or permanent loss of Platform access.

15. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, OnlySniff disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

16. Limitation of Liability

To the maximum extent permitted by law, OnlySniff shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Platform. Our total liability shall not exceed the amount paid by the user to OnlySniff during the twelve (12) months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless OnlySniff, its owners, affiliates, employees, and partners from claims, damages, liabilities, and expenses arising from:

• Your use of the Platform.
• Your content.
• Your products or services.
• Your violation of these Terms.

18. Changes to These Terms

We may update these Terms at any time. Continued use of the Platform following publication of updated Terms constitutes acceptance of the revised Terms.
